You should really contact a lawyer. THIS IS NOT LEGAL ADVICE, but the city has a duty to ensure that it s public works projects are maintained in a safe condition. If there were previous accidents, there will be reports of same to support your case. It sounds like the city is not providing proper drainage for the road, and they should have. Again, this is not legal advice.

Thanks for the tips. My doc said that there is no cast that will help this type of break, I just have to be easy on it and it will hopefully heal. He said that it "won't let you hurt it, at least right now" and he is correct. If I make the mistake of moving it the wrong way it feels akin to someone driving a steak knife in my deltoid with a ball-peen hammer.
If it does not heal on its own in 6 weeks, he will put screws in it.
After some investigation, it seems this intersection has a history of motorcycle, scooter, bicycle and pedestrian crashes. I talked with the people in the office on that corner, and they've all witnessed two-wheeled crashes there, and one slipped and fell just walking across the street.
What's that attorney's number again????

Ouch. Someone mentioned algae causing crash. Someone else mentioned the 405 and the 10 fwys.
I have dumped it in water/algae before but I kind of figured there might be algae in there and went dn at less than 5 mph.
The 405 fwy in Los Angeles is a nightmare. Cagers just seem to hate motorcycles/motorcyclists on it. Probably has much to do with cagers often getting stuck in severe congestion and being late to work. Be esp. careful between the 10 Santa Monica Fwy and the 101 Ventura Fwy on the 405.
I have had a couple of close calls on the 405 San Diego Fwy. Portions south of the 10 have been under construction for years and there is no emergency lane in places and lanes are thinner than normal.
You almost need to carry a shotgun like the terminator!

engine flutter @ 5,500 rpm
The performance slowly degraded and this morning it could only get to 4,000 rpms. This is the third time I had the diaphragm out but the two tears were now very obvious (about 5mm long this time). I can't believe that I didn't see them when they were limiting performance to 5,500 rpms.
If you need to replace yours, go to a Harley dealer and ask for Part # 27585-88, they seem to always have one in stock. It was less than $50 with tax. The Kawi dealer wants $132 for the same thing plus they'll have to order it.

What I have noticed lately is that it seems like it is running out of gas at 5,500 rpms. I'll run 3rd gear up to that and maybe a little past, shift into 4th and the engine 'flutters' at 5,500 rpms at full throttle, it continues to flutter in 5th and the rpms will very slowly creep up still at full throttle. Not awe inspiring at this point - something is noticably wrong and slowly getting worse. > > 1.) I checked the valve clearances - all were well within spec > 2.) I'm thinking: fuel or air, not timing because the engine will initially rev up and over 5,500 rpms but then seems to become 'starved' until you leave off the throttle and it can catch up. > > I still have the original vacuum line between the carb and petcock - maybe it is now leaking / collapsing under higher stress, thereby restricting fuel flow.
